1. Provider and subject matter
resido GmbH, Wichertstraße 14a, 10439 Berlin, Germany (Provider) operates a programming interface based on the Model Context Protocol at https://mcp.ferienhausmiete.de (Interface). It enables AI assistants and other software to search holiday accommodations on ferienhausmiete.de, retrieve details, prices and availability and link to the listing page. The Interface is read-only. Inquiries, bookings and contracts are concluded exclusively on ferienhausmiete.de between guest and host.
2. Users
Users of the Interface are operators of software that integrates the Interface (e.g. providers of AI assistants, developers) and end users who search through such software. These terms are deemed accepted upon the first call of the Interface. The terms of use of ferienhausmiete.de apply in addition insofar as they are applicable to the use of the Interface; in case of conflict these Interface terms prevail.
3. Permitted use
The Interface may be used to enable end users to search for and obtain information about holiday accommodations and to lead them to the listing page on ferienhausmiete.de. Retrieved content may be displayed, summarised and translated for the end user in connection with their request. The source (Ferienhausmiete.de) and the link to the listing must be retained.
4. Prohibited use
The following is not permitted:
a) building own databases or directories from the retrieved content, in particular storing it beyond answering the specific request; technical caching for up to 24 hours is permitted;
b) passing on, selling or licensing the content to third parties;
c) using the content to train, fine-tune or evaluate AI models (reservation of rights under Section 44b(3) German Copyright Act);
d) using the content for price monitoring, competitive analysis or contacting hosts outside ferienhausmiete.de;
e) circumventing access limits, using several identifiers for that purpose, or access that impairs operations;
f) presenting the content in a way that suggests the user is the provider of the accommodations or the guest’s contracting party.
5. Rights in content
All content (texts, photos, prices, availability, reviews, database structure) remains the property of the Provider or the respective hosts and is protected by copyright and database law (Sections 87a et seq. German Copyright Act). The user receives a simple, revocable, non-transferable right of use within the scope of section 3.
5a. Trademarks and attribution
The user may use the name „Ferienhausmiete.de“ and the Provider’s logo solely to attribute the retrieved content. Any presentation that claims or implies a partnership, endorsement or certification by the Provider, and any use as part of own product names, domains or advertising, is not permitted.
5b. Indemnification
A user who integrates the Interface into own software shall indemnify the Provider against third-party claims arising from use of the Interface or the content by the user or its end users in breach of these terms or applicable law, including reasonable costs of legal defence. The user shall inform the Provider of such claims without delay.
6. Access limits, identifiers
The Provider may limit access per user or identifier and may issue identifiers (API keys). Requests exceeding the limits are rejected; repeated violations may lead to suspension. The current limits are published at www.ferienhausmiete.de/l/mcp-en/.
7. Availability, changes
The Interface is provided without any availability commitment. The Provider may change functions, data fields, limits and these terms or discontinue the Interface. Material changes are announced at www.ferienhausmiete.de/l/mcp-en/ with 30 days‘ notice; security-related changes may take effect immediately.
8. No warranty for content
The content originates from the hosts. The Provider does not review it in advance and gives no warranty as to accuracy, currency and availability. Prices and availability are statements of the host; only the host’s offer on ferienhausmiete.de is binding.
9. Liability
Section 17 of the terms of use of ferienhausmiete.de applies accordingly.
10. Data protection
When the Interface is called, the Provider processes technical data (IP address of the calling system, time, search parameters, identifier) for operation, security and access limitation; details are set out in the Privacy Notice for the Interface. A user who integrates the Interface into own software is responsible for informing its end users and for the legal bases of processing on its side.
11. Suspension, termination
The Provider may suspend access without prior notice in case of violations of sections 4 or 6. The user may stop using the Interface at any time.
12. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for merchants, legal entities under public law and special funds under public law is Berlin. Should individual provisions be invalid, the remaining provisions remain in force. This English version is a convenience translation; in case of discrepancies the German version prevails.
